TERMS AND CONDITIONS OF SALE AND SUPPLY

Title
Title to all goods sold by Tomlinson Furniture Group Ltd shall remain with the seller until the full invoiced amount has been paid.

The company by its employees or agents shall be entitled to enter upon or into any land building or vehicles of purchaser to retake possessions of the goods, if title remains with the seller as defined above.

Prices
Prices quoted and marked on items for sale do not include VAT which will be charged at the rate ruling on the day of invoice. Prices quoted do not include packaging or delivery. Unless agreed in writing, orders cannot be cancelled by the customer and full payment (together with any costs) is payable

Collection
If goods are not collected within the agreed timescale the vendor retains the right to charge for storage or resell the goods and refund and monies paid (less handling costs).

Late Payment                                                                                                                              The seller retains the right at any time to charge interest on a day to day basis (at an annual rate of 4% above Barclays Bank PLC Base lending rate) from the agreed due date on late payments.

Quality                                                                                                                                     The assessment of the goods’ suitability, merchantability, quality and fitness for purpose is the Buyer’s responsibility. 

It should be noted that the vast majority of our products are comprised of real wood. This is a natural living substance and will be subject to some movement as it is exposed to varying temperatures.

Liability                                                                                                                                             So as far as concerns damage caused to the Customers goods whilst still in the possession of the company.  The company shall be liable to the customer (and then only to the limited extend set out below) only if and in so far as such damage is caused by the negligence, breach of duty or other wrongful act or omission of the company itself or its directors or servants acting within the course of their employment.

Liability in all cases whatsoever is limited to the invoice price paid for the goods, which are the subject matter of any claim. Notification of claims must in all cases be served on the Company’s Head Office within 7 days of goods being collected or received by the customer.
